1. Standard Terms
These terms and conditions cover all aspects of the website and mobile app design and development services provided by Digital Homeez. By entering into a contract with us, you agree to abide by these terms for any work we undertake.
2. Fees and Deposits
Upon accepting our proposal, you will be required to pay an initial deposit ranging from 25% to 50% of the total project cost. This deposit is due before we begin any work. The remaining payments will be due upon successful completion of the project, subject to the terms regarding “approval of work” and “rejected work.” Work will not commence until the deposit is fully paid. The deposit is refundable only if we do not fulfill our contractual obligations. However, if development has already started and you choose to cancel the contract, the deposit is non-refundable.
3. Supply of Materials
You are responsible for providing all necessary materials and information required for us to complete the project. This may include content like images, text, logos, and other relevant materials. Any delays in supplying these materials may extend the agreed project timelines. If the delay prevents us from moving forward with the project, we reserve the right to bill you for the completed portions of the work.
4. Changes and Revisions
We are happy to accommodate reasonable revisions to the design during the development process. However, excessive changes may be subject to additional charges. We reserve the right to limit revisions if they exceed a reasonable amount beyond the original project scope.
5. Project Timeline and Client Responsibilities
All timeframes and deadlines we provide are based on full cooperation and timely feedback from you. It is essential that you assign a single point of contact who will be available for daily feedback and to help keep the project on track. Delays on your part may impact the project’s timeline.
6. Approval of Work
Once the project is completed, you will be notified and given a chance to review the work. If you find any issues, you must notify us in writing within 7 days. If no concerns are raised within this period, the work will be considered approved, and any further changes may not be accepted. Once approved, the balance of the project fee will become due.
7. Handling Rejected Work
If you reject the work during the review period or fail to approve the revisions we make, and we reasonably believe that you are rejecting the work unfairly, we reserve the right to terminate the contract and take steps to recover payment for the work completed.
8. Final Payment
The balance of the project fee will be due immediately after the 7-day review period, following approval or deemed approval of the completed work.
9. Intellectual Property and Usage Rights
It is your responsibility to ensure that all content, logos, and materials you provide for use in your website or application are free from intellectual property violations. You must have proper permissions and rights for any material submitted. We are not liable for any legal issues regarding the content you provide and will be held harmless from such claims.
10. Licensing of Completed Work
Once full payment is received, we grant you a license to use the website, mobile applications, and any related software for the lifetime of the product.
11. Limitation of Liability
We are not liable for any losses or damages that arise from delays or non-performance of the contract. This includes, but is not limited to, delays caused by unforeseen circumstances or factors outside our control.
12. Disclaimer
To the extent permitted by law, all warranties and representations regarding the services provided are excluded, except for those expressly stated in this document. Any legal liabilities that cannot be excluded by law.
